Terms of service

The terms for using Click N Clear.

These terms govern the Click N Clear mobile app and this website, operated by Nickel City Click N Clear LLC. By creating an account or using the app or website, you agree to them. Sections 5 and 6 apply to property owners and contractors respectively; everything else applies to everyone.

Our role

Click N Clear is a marketplace. Property owners post outdoor work they need done, independent contractors bid on it, and the owner chooses which bid to accept. The contract for the work is between the property owner and the contractor. Nickel City Click N Clear LLC is not a party to that contract, does not perform, supervise, or inspect the work, does not employ contractors, and does not guarantee that any job will be bid on, accepted, completed, or completed to any standard. We provide the app, the matching, the messaging, and the payment processing through Stripe.

Eligibility

You must be at least 18 years old and able to enter a binding contract to use Click N Clear. Contractors must be legally permitted to perform the work they bid on and to receive payment for it. By using the app you confirm both.

Accounts

You must provide accurate information and keep it current. You are responsible for activity under your account and for keeping your login credentials confidential. One person may not hold more than one account of the same type without our permission. We may suspend or close an account that provides false information, is used for fraud or abuse, or violates these terms.

How jobs work

A property owner posts a job with the property address, the service, the yard size, the price the owner will pay, the date and time, any instructions, and photos. Contractors whose service area covers the property can see the post and submit a bid. The owner reviews bids and accepts one. When a bid is accepted, the job appears in the contractor's My Jobs and the two parties can message each other in the app. The contractor performs the work and marks the job complete. Payment is released as described in section 8. If no contractor bids before the posting window ends, the owner is notified and may post the job again.

Property owners

Authority. You confirm that you own the property or are authorized to arrange work on it, and that you consent to the contractor entering the property to perform the accepted job at the scheduled time.

Accurate posts. You are responsible for the accuracy of the address, the description, the yard size, the photos, and the instructions. Disclose hazards and access requirements, such as gates, pets, sprinkler heads, or obstacles, in the post or by message before the job.

Your price. You set the price you will pay for the work. A service fee is shown before you confirm a booking, and the total you will be charged is displayed before you commit.

Choosing a contractor. You choose which bid to accept. Click N Clear does not select contractors for you and does not vouch for any contractor beyond the insurance certificate requirement described in section 7.

Contractors

Independent contractor. You are an independent business, not an employee, agent, partner, or joint venturer of Click N Clear. You decide which jobs to bid on, set your own service area, supply your own equipment and materials, control how the work is done, and are responsible for your own taxes, licenses, permits, and insurance. Nothing in these terms creates an employment relationship or entitles you to benefits of any kind from Click N Clear.

Your bids and your work. A bid you submit is an offer to perform the posted work at the posted price on the posted schedule. When the owner accepts it, you are obligated to perform the work as posted, in a workmanlike manner, in compliance with applicable law, and with reasonable care for the property and the people on it. Mark a job complete only when the work is done.

Companies. If you register as a company, you confirm you are authorized to bind the company, and the company is responsible for the people it sends to perform work.

No solicitation off the platform. Do not use the app to obtain an owner's contact information in order to move the same work off the platform to avoid fees.

Insurance

Every contractor must submit a certificate of insurance before taking jobs on Click N Clear, and must maintain that coverage while using the platform. When the app or website says a contractor is vetted for insurance, it means that the contractor submitted a certificate of insurance at signup. Click N Clear does not verify the certificate with the insurer, does not confirm that coverage is in force on the day of any particular job, and does not review policy limits or exclusions. Maintaining adequate, current insurance is the contractor's responsibility, and a contractor whose coverage lapses must stop taking jobs until it is restored. Property owners who want to confirm coverage may ask the contractor for a current certificate before the job.

Click N Clear may link contractors to an independent insurance agency as a convenience. Click N Clear is not a licensed insurance producer, does not sell, quote, negotiate, or advise on insurance, and may receive a referral fee from the agency. Any coverage you obtain is a contract between you and the insurer.

Payments and fees

Stripe. All payments and payouts are processed by Stripe. Property owners pay through Stripe when they book. Contractors must set up a Stripe account to receive payouts, and by doing so agree to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service, available at stripe.com/legal. Click N Clear does not hold card numbers or bank account details.

Fees. Property owners pay the price they set plus a service fee that is shown before they confirm. Contractors pay Click N Clear a percentage of each completed job; the price on every post is shown before you bid, and the fee is disclosed in the app. Fees may change with notice in the app, and a change does not affect jobs already accepted.

Payouts. When a job is marked complete, the contractor's earnings are credited to the contractor's balance in the app. Contractors may withdraw on demand for a small fee that is shown before you confirm the withdrawal, or wait for the free scheduled payout. Payouts are made only to the connected Stripe account.

Taxes. Contractors are responsible for all taxes on amounts they earn through the platform. Click N Clear or Stripe may issue tax forms where the law requires.

Cancellations, no-shows, and problems with a job

Contractor no-show. If a contractor does not show up for an accepted job, the property owner is not charged for that job, and the owner may post the job again.

Cancellations. Either party may cancel an accepted job through the app before the work begins. Repeated or late cancellations may result in suspension of the cancelling party's account.

Problems with completed work. If an owner believes a job was not completed as posted, the owner should contact the contractor through the app and, if that does not resolve it, contact Click N Clear at the address in section 18 within a reasonable time after the scheduled date. We will review the job record and may, in our discretion, adjust or withhold payment, issue a refund, or take action on an account. Our review is a courtesy to help resolve the dispute; it does not make Click N Clear a party to the work or responsible for its outcome.

Chargebacks. If a property owner disputes a charge with their card issuer rather than through the app, we may suspend the owner's account while the dispute is resolved.

Your content

You keep ownership of the photos, descriptions, messages, and other content you submit. You give Click N Clear a non-exclusive, royalty-free license to store, display, and share that content within the platform for the purpose of operating the marketplace, including showing job details to contractors who can bid and to the contractor who takes the job. You confirm you have the right to submit the content and that it does not violate anyone else's rights. We may remove content that violates these terms.

Conduct

You agree not to: post false or misleading information; harass, threaten, or discriminate against another user; use the platform for any service other than the outdoor work it offers; interfere with or attempt to gain unauthorized access to the app, other accounts, or our systems; scrape or copy platform data; use the platform to violate any law; or circumvent fees. Treat the people you meet through Click N Clear, and their property, with respect.

Disclaimers

The app and website are provided "as is" and "as available." To the fullest extent permitted by law, Nickel City Click N Clear LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any contractor is qualified, that any job will be performed or performed well, that any job will receive bids, that the app will be uninterrupted or error-free, or that information posted by users is accurate. You use the platform and engage other users at your own risk.

Limitation of liability

To the fullest extent permitted by law, Nickel City Click N Clear LLC and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, property damage, personal injury, or other loss arising out of or relating to the work performed by a contractor, the condition of a property, the conduct of any user, or your use of the platform. To the fullest extent permitted by law, our total liability for any claim relating to the platform is limited to the greater of the fees you paid to Click N Clear in the twelve months before the claim or one hundred dollars. Some jurisdictions do not allow certain limitations, and nothing in these terms limits rights that cannot be limited under applicable law.

Indemnity

You agree to defend, indemnify, and hold harmless Nickel City Click N Clear LLC and its owners, employees, and agents from any claim, loss, or expense, including reasonable attorneys' fees, arising out of your use of the platform, your violation of these terms, your violation of any law or the rights of another person, the work you perform or arrange through the platform, or, for property owners, the condition of your property.

Termination

You may close your account at any time in the app or by emailing us. We may suspend or terminate your access at any time for violation of these terms, suspected fraud or abuse, legal risk, or to protect other users, and we may decline to offer the platform to anyone at our discretion. Accepted jobs, amounts owed, and sections 10 through 17 survive termination.

Governing law and disputes

These terms are governed by the laws of the State of New York without regard to its conflict-of-law rules. Any dispute arising out of these terms or the platform will be brought in the state or federal courts located in Erie County, New York, and you consent to the jurisdiction of those courts. Before filing a claim, you agree to contact us at the address in section 18 and make a good-faith effort to resolve the dispute informally for thirty days.

General

These terms, together with the Privacy Policy, are the entire agreement between you and Nickel City Click N Clear LLC about the platform. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a sale or reorganization of the business. We may update these terms as the platform or the law changes; the effective date at the top identifies the current version, and we will notify you in the app or by email of material changes before they take effect. Continued use after a change means you accept it.
